The registration, the use of services and the use of https://www.bellaitalidirect.com owned and managed by Cinque Terre Riviera Incoming Tour Operator belonging to Cinque Terre Riviera snc entails acceptance by the user of the General Conditions mentioned below. www.bellaitaliadirect.com properties are offered for rental for daily, weekly or monthly stays. The site also offers tourist activities. The owners of each property (the “Owner”) has given the Agent (bellaitaliadirect.com managed by cinque terre riviera snc) the authority to enter into this Agreement. This Agreement sets forth the terms under which You will lease the property through the Agent. Registration and use of services are accessible only to adults with the capacity to act. Customers wishing to register are required to disclose only their personal data and guarantee that such data are true, correct and up to date. The following terms and conditions regulate the contractual relationship between the Guest and Customer hereafter named “Client” and bellaitaliadirect.com hereafter named “Agency” during the the process of reserving and paying an accommodation or a tourist service selected directly from the website bellaitaliadirect.com hereafter named “Website” purchased via any device such as computer, laptop, mobile phone or by e-mail or via phone call. The client is required to accept these General Terms and Conditions and the specific conditions relating to the stay or individual services (such as duration, price, applicable taxes, extra fees and existing legislation). Before making any type of reservation, the Client is invited to read well and attentively all the General Terms and Conditions and any special conditions applicable to specific services. Once the reservation is completed either for accommodation or activities services offered by the Company, the Client automatically accepts the General Terms and Conditions described here. The General Terms and Conditions may be changed at any time, without any notice, it being understood that such changes will not be applied to orders submitted by the Client before the change.

1. RESERVATIONS
The Client can reserve accommodation and services from the platform bellaitaliadirect.com. Accommodation pricing and availability is constantly updated and reservation can be made in real time with immediate confirmation. Some activities could be on request and this will be clearly notified on the platform. A reservation will be complete only after the Client follows all the directions provided by the Agency platform to complete downpayment or payment and the Client receive a final confirmation. In case only a downpayment is requested at time of reservation, the Client will have to take all further steps prompted by the Agency platform to complete the final payment.
2. PRICES AND SERVICE FEES
Prices are calculated in Euro and cover the room / villa / apartment stay mentioned in the booking. The price does NOT include personal expenses, such as mini-bar, telephone calls, wifi, pay TV use or other services offered by the room / villa / apartment. Prices and cancellation policy are made clear before the Client’s reservation has gone through as well as final cleanings and damage deposit.
3. CHECK-IN
The Client agrees to respect the property check-in time (normally from 3:00 PM until 6:00 P.M.) notifying anyway arrival time top the Owner or to the Agency. Other arrangements can be taken on a private basis and at eventual extra charges over the established amount for the rental and eventual package. The Owner will use commercially reasonable efforts to have the Premises ready for the Client’s occupancy at check-in time, but Agent and Owner cannot guarantee the exact time of occupancy. If the Client foresees that there will be a delay in arriving at the room / villa / apartment, he/she must contact the number provided for the check-in on the information sheet and notify the delay. In the event that the Client requests an ASSISTED late check-in and an Agent or Owner can accomplish the request, the Client agrees to pay a late check-in fee if the clients needs to be assisted or if the property has a mandatory assisted check-in. Otherwise keys will be left near property and the Client will be given instructions to pick them up at no extra cost. Failing to receive any communication about a late arrival the Agent or Owner will leave keys by the property and no assistance will be given. Please, note that Keys pick-up instructions will be provided only after the Client has anyway completed the online check-in procedures. Some properties will always have un-assisted check-in. The Client will be informed about this option. For any type of check-in an online check-in form will have to be filled by the Client so that the Owner / Agent is able to to gather all the necessary personal documentation of the guests as required by the Italian Law. No access code or key to enter the property will be provided in absence of personal documentation.
- 3.1 ASSISTED LATE CHECK-IN FEES
Assisted late check-in is possible only on request with assigned time and up to 10:00 pm, with pricing varying from 50.00 euros to 80.00 euros.
Assisted Late Check-in fees will be lowered in case of real emergencies at owners and managers discretion, but consider that providing assistance in small hamlets and remote locations at late hours is extremely complicated for owners and assistants e.g. they might not have trains to go back to their homes too late at night For some properties, unassisted late check-in will not be possible and the Client will be informed at time of reservation.
- 3.2 EARLY CHECK-IN
In case of early arrival, before 3:00 p.m., owners and property managers will do their best to let the Client in as soon as possible. Management and cleaners are responsible for the Client safety and they have to be sure the property the Client rented is completely sanified before he/she enters it. In some locations a baggage storage area is available, which can be booked in advance. The owner / agent will provide detailed info about them.
4. CHECK-OUT
1. Check-out is normally within 10:00 a.m. the Client will be told on arrival where to leave keys in case of early check-out.
If a damage deposit has been taken, the assistants will tell us to release it only after survey to the apartment and, if no damage will be notified, it will be automatically refunded on your card. You’ll receive the amount back within one week approx. depending on each credit card company procedures and timing.
- 4.1 LATE CHECK-OUT
Generally it’s quite impossible to get late check-outs at private properties, especially during the high season. Caretakers need time to clean and prepare the room / apartment for the following guests of the same day. Owners and Agents can check if allow some extra time can be granted to their guests. They will only know if possible late afternoon of the day prior to your departure, when following guests arrival time and cleaners schedule will be announced.
In the event the Client returns to the Premises without the consent of the Agent or Owner past check-out, a fee equal to the rental rate for one (1) day will be assessed to the Client.
5. BOOKING AND PAYMENT GENERAL INFO
As the Client send an intention to book a property and the Client will receive all payment info.
The procedure will go through, automatically prompted, if the Client do an online reservation through the platform.
6. PAYMENTS
For online reservations the Client will be asked to pay the Downpayment or Full Payment depending on chosen purchase rate and, if no payment will be received with 30 minutes, the Client reservation will bee automatically canceled from the system.
Downpayment or Balance have always to follow the rules of the fare customers choose at time of reservation. The Client will have to sign acceptance of a rental agreement or, anyway, of the rules specified at the time of reservation and provide a credit card number as guarantee to cover costs of damages.
- 6.1 BANK TRANSFER PAYMENTS
The Client can pay the whole amount of his reservation via bank transfers only if the owner accepts this payment solution. The Client has to know that expenses must be at sender charge. In case high wire transfer expenses will be charged on the Owner’s account, the Owner or Agency will be allowed to charge them back on the Client’s bill at time of final payment or locally on arrival. Bank Transfer info will be provide via email after customer’s request.
Bank transfer expenses must be at the Client charge, so please specify this term to your bank. Due to the complexity of this payment type, Owners can accept it only 15 days before the Client arrival. Only after the Client receives final confirmation that the wire transfer has reached the owner’s / agent’s account, the Client’s booking will be completed and the cLient will be able to download receipt and, in case of final balance, arrival instructions.
- 6.2 CREDIT CARD PAYMENTS
The Client will find a secure payment gateway though Stripe or Gestpay. Major credit card such as VISA, MASTERCARD and AMERICAN EXPRESS are accepted. Wire Transfers on request. The names given for booking must be those of the people who shall use the booked services: repeated or missing names may cause the hotel / villa / apartment to refuse the booking. Only after the Client will receive the Agency reconfirmation message (once payment controls have been made), the Client booking will be completed and he/she will be able to download receipt and, in case of final balance, arrival instructions.
Please, when paying using a credit card, the Client has to authorize through own bank a foreign country supplier charge, if the card is under a security and antifraud protection plan.
- 6.3 CITY TAX LOCAL PAYMENT
Vernazza and Corniglia, Riomaggiore and Manarola Town Councils approved the application of a City Tax (Tassa di Soggiorno). Such Tax is in force since 2015. The City Tax is not p the Client will be requested to give id cards and to pay CASH ONLY the relative amount. Failing to pay the city tax the Town Council may fine customers with penalties from 105,00 to 500,00 euros.
- 6.4 TRAVEL DOCUMENTATION
As the Client completes payment before the arrival, he/she will receive all the necessary information for check-in, stay and check-out.
Please, stay in touch with the Agency and the Owner close to arrival day, share arrival time and update eventual delays. It is extremely important!
7. CANCELLATION AND DATE CHANGES PENALTIES
7.1 CANCELLATION
Due to the peculiar kind of properties this platform represents, exclusive private villas, apartments and rooms, Agency and Owners have to apply special terms for cancellation and amendments. Please, carefully read detailed cancellation policies at time of reservation, so not to incur in unpleasant “surprises” when a cancellation may occur. A cancellation can be done sending an email to the Agency of this platform: info@bellaitaliadirect.com Once the reservation has been cancelled, the Agency will send a cancellation notice stating the cancellation fee to your mailbox. Our accounting department will credit your account with the amount minus penalties and cancellation fee in case your statement shows a credit on your side. To protect against cancellation caused by unforeseen events, such as illness in your family, worker strikes and more, the Agency recommends purchasing a trip cancellation insurance to provide recourse for deposits and balances paid.
7.2 Date Changes
I. Date changes made between booking date and 8 weeks before arrival are subject to a penalty fee of 50,00 eur + possible difference in rate due to customer request for a higher rated period. II. Date changes made between booking date 8 weeks before and the date of arrival are subject to a penalty fee of 100,00 eur + possible difference in rate due to customer request for a higher rated period. Changes are all subject to availability and owner’s acceptance. Any postponements or exchanges are entirely at the discretion of the owner or property management. Cinque Terre Riviera does not guarantee exchanges and makes no representations or warranties regarding a customer’s right to exchange. When permitted, only one scheduled exchange will be allowed. Beyond that the cancellation policy as per point 7.1 will be enacted in full.
8. REFUNDS
Bellaitaliadirect.com does not provide refunds for any reason beyond that which is covered in these terms. Refunds are not provided for declarations of war, acts of war, travel alerts or warnings issued by the Italian government or any other government, airline related stoppage or re-routings, or any other events beyond its control. Bellaitaliadirect.com will not be held liable or provide any refund due to the condition of certain amenities, including air conditioning, dishwasher, washing machines, private telephones, wifi, lack of heating during forbidden season (Apr 1st - Oct 31st) and other appliances. Please note: only local authorities in Italy may stipulate when and for how long heating may be turned on from April 1st through October 31st. Please, evaluate that weather in Italy might be cooler than what you expect from Apr 1st to Oct 31st. So bring warm clothes and, if you still need heating, owner may accept to turn it on at his own risk of incurring in high penalties, but against extra charge depending on sizes of the property you rent. Please, ask in advance. Houses in Europe and else where are sometimes a limited amount of electricity of 3 kilowatts. The use of too many appliances at the same time will flip a circuit breaker and shut off the electricity. Bellaitaliadirect.com will not provide a refund if electricity is lost temporarily due to a circuit breaker being triggered. Most of the rooms and small apartments in Italy are equipped with hot water boilers. The amount of hot water is limited and guests need to use water wisely when showering. Then, if out of hot water, guests just have to wait for the boiler to heat water again. Bellaitaliadirect.com will not provide a refund for boiler limited amount of hot water. Where pools are provided, the general season for pools in Italy begins June 1 and ends September 15. Most pools are not heated. No extra fans or air conditioning are provided on the spot if the villa you have reserved does not have those appliances among its facilities at time of reservation. Clothes washers are provided only if listed among property facilities at time of the Client reservation.
9. USE AND TENANT DUTIES
The use of the Premises is restricted to use by the Client and the persons enclosed in the initial reservation. No exceeding number will be accepted unless the Client requests a change of terms and pays eventual surcharge for the extra guests. Extra guests will not have to exceed, anyway, the maximum number of guests allowed for the specific property you rented. No event will be authorized if not after an agreement with owner or property manager. Agent considers the Client hosting a special event, without Agent’s prior consent or knowledge, a material breach of this Agreement. In that instance, the Client agrees to immediately pay an amount equal to the Special Event Fee in liquidated damages. Use Of the Premises by Fraternities, Sororities or Unrelated Groups Under 21 Years of Age Is Strictly Prohibited and Lessee agrees that, in the event Owner or Agent discovers same, that ANY AND ALL FUNDS COLLECTED AS RENT will be considered LIQUIDATED DAMAGES to cover losses, expenses and damages of the Owner and Agent for Lessee taking the premises off the market. Occupancy shall not exceed the maximum number allowable by law. Please contact bellaitaliadirect.com directly for further information. The Client agrees to comply with all obligations imposed on you by this Rental Agreement with respect to maintenance of the Premises, including but not limited to, the following: (a) keep the Premises as clean and safe as the conditions of the Premises permit, and cause no unsafe or unsanitary conditions in the common areas and remainder of the Premises that the Client uses; (b) dispose of all rubbish, garbage and other waste in a clean and safe manner and differentiate that as per local rules; (c) keep all plumbing fixtures in the Premises or used by the Tenant as clean as their condition permits; (d) not deliberately or negligently destroy, deface, damage, or remove any part of the Premises or render inoperable the smoke detector or pool alarm, if applicable, provided by the Owner, or knowingly permit any person to do so; (e) comply with all obligations imposed upon the Tenant by current applicable building and housing codes; (f) be responsible for all damage, defacement, or removal of any property inside the Premises that is in Your control unless the damage, defacement, or removal was due to ordinary wear and tear, acts of the Owner or Owner’s agent, defective products supplied or repairs authorized by the Owner, acts of third parties not invitees of the Tenant, or natural forces; (g) notify Agent in writing of the need of replacement of and/or repairs to a smoke detector, and replacing the batteries as needed during the tenancy. You agree not to use the Premises for any activity or purpose that violates any law or governmental regulation. Your breach of any duty contained in this paragraph after commencement of tenancy shall be considered material, and shall result in the termination of Your tenancy with NO REFUND OF RENT. SMOKING IS STRICTLY PROHIBITED IN ANY PROPERTY MANAGED BY CINQUE TERRE RIVIERA FIREWORKS OF ANY NATURE WHATSOEVER ARE STRICTLY PROHIBITED.
10. SECURITY DEPOSIT
The security deposit is not included in the rental fee (aka breakage fee). The Client is required to provide a security deposit via credit card deposit before you enter the property you reserved. Each property shows the amount of security required. Failure to provide the required security deposit, as set forth herein will be considered a breach of agreement on the part of the customer and the owner may refuse entry to the house without it. When a dispute between owner and guest arises over any forfeiture of deposit held by bellaitaliadirect.com, the deposit dispute will be awarded to the owner unless we have strong belief otherwise. Customer acknowledges and agrees that bellaitaliadirect.com cannot be held liable for the forfeiture or loss of a security deposit for any reason whatsoever, nor will bellaitaliadirect.com be held liable due to dispute arising from a security deposit.
11. ADDITIONAL CHARGES
There may be additional charges payable at the rental as required by the owner, caretaker or managing agent. Additional charges (final cleaning, baby’s bed or additional people staying in the rental for example) should be paid at the beginning of your stay, not at the end. Charges such as telephone, electricity, heat, gas (if by meter), additional linens, towels or cleaning charges, and more will be due during your stay and alway before the end of stay. Although we try to keep additional charges listed on the property pages current, bellaitaliadirect.com cannot be held liable for any change to these amounts due. Leaving the property in a condition requiring excessive cleaning upon departure (including but not limited to cleaning of upholstery, shampooing of the rugs, breakage, soiling or damage to the interior or exterior caused solely by the customer) may result in further charges and a forfeit of deposit. Customers are required to leave the rental as it was on arrival. Dishes, cutlery and pots will not have to be left dirty with leftovers.
12. GUARANTEES
bellaitaliadirect.com guarantees all properties will be available upon arrival in accordance with confirmed reservations and pursuant to these Rental Terms. If for some unforeseen reason the rental is not available because it is either: 1) destroyed for unpredictable natural events 2) uninhabitable due to structural damage 3) uninhabitable due to an extended failure of essential equipment and fixtures such as heating, electrical systems, plumbing 4) rented to another party before your reservation occurred and by a error it was not properly recorded due to digital system failure bellaitaliadirect.com will immediately attempt to find another rental of similar or higher quality, cost and size. Failing this, a full or partial refund, not exceeding paid rental amount, will be provided to the customer in accordance with the situation. IN NO EVENT WILL bellaitaliadirect.com BE LIABLE FOR AN AMOUNT GREATER THAN THE RENTAL PRICE PAID BY CUSTOMER.
13.PRIVATE VILLAS, APARTMENTS ROOMS CLASSIFICATION
At the moment there is not an official classification for private villas, apartments and rooms. bellaitaliadirect.com selects and publishes only those properties that satisfy our very strict quality criteria and puts their description on-line, which allows the customer to evaluate and accept the hotel. All the properties for rental are in possession of a Regional and National License. It can be recognized by the CITRA or CIN code assigned and published on our website and on each OTAs page dedicated to each single property. Please Note: in some properties double beds are not available and double rooms feature two single beds, linked or separated, or a fairly small double bed. Double Beds in Italy are usually comparable to an American / International Queen Size Bed.
14. CUSTOMERS’ OBLIGATIONS
Travelers must have a valid passport or other identity document accepted for entry in our properties. The participants shall have to observe all normal cautions and the specific laws and regulations in force in Italy. Luggage is transported at the customer’s risk, and the organization shall in no way be held responsible for losses or damages. No porterage is provided for our properties, unless otherwise specified. Agency staff assisting at check-in or check-out are not entitled to do any porterage services. CONSIDER TO TRAVEL WITH LIGHT BAGGAGE. IT IS ALWAYS A GOOD RULE ESPECIALLY IN LIGURIA AND CINQUE TERRE. Should you feel you may need baggage porterage, please notify it at time of reservation and we will look for available services at extra charge.
15. ORGANIZATION OBLIGATIONS
If, before or after customers’ departure, the owner for whatever reason, other than for reasons of the customer, cannot supply an essential part of the contracted services, it will provide alternative solutions, without surcharges for the customer, and if the supplied services’ value is inferior to that of the contracted ones, the owner directly or through bellaitaliadirect.com will refund the customer with an amount equal to the price difference between the contracted services and the supplied ones.
16. PROTECTION OF PRIVACY
When booking a stay on our website, the Client is required to provide personal information, such as name, e-mail address, address, telephone number. This information allows us to process your booking and the sale of our services, and to keep the customers updated on the state of their bookings or to contact them in case of problems. Processing of personal data is carried out in full compliance with the existing laws - General Data Protection Regulation GDPR (EU) 2016/679 (General Data Protection Regulation) in the current version of the OJ L 119, 04.05.2016; cor. OJ L 127, 23.5.2018 on the protection of personal data -, which can be viewed directly on our website privacy page.
17. MANAGEMENT OF CREDIT CARDS AND BANK ACCOUNTS DATA.
The Client credit card data, which are necessary in order to pay for our services, are never memorized by bellaitaliadirect.com information system; they are managed directly and exclusively by the information systems of stripe.com, the company managing credit card payments, or Banca Sella, in case of card payment or bank transfer, in full compliance with the existing laws - General Data Protection Regulation GDPR (EU) 2016/679 (General Data Protection Regulation) in the current version of the OJ L 119, 04.05.2016; cor. OJ L 127, 23.5.2018 on the protection of personal data - which can be viewed directly on our website.

10. SECURITY DEPOSIT
Contracts regard the offer of hotel / villa / apartment stays only, as they cannot be considered agreements for travel organization or tourist packages, and are regulated by the following provisions of the International Convention on Travel Contracts (CCV) -Brussels, April 23, 1970 – art. n.1, n.3 and n.6; art. n.17 to n. 23; art. n. 24 to n. 31, with regard to provisions that differ from those regulating travel organization agreements and other agreements concerning the sale of the single service which is the object of the agreement.
19. DISCLAIMER
This site bellaitaliadirect.com is provided by Cinque Terre Riviera on an “as is” basis and might contain errors or typographical mistakes. Cinque Terre Riviera does not provide any representation or warranty, either explicit or implicit, on the site functioning, the information contained therein, the software or the products present in the site. As far as the Italian legislation allows it, Cinque Terre Riviera rejects any representation or warranty, either explicit or implicit, including warranties of ability or fitness for particular purposes. Compulsory notice Pursuant to Art. 16 of Law 269/98 organization or tourist packages, and are regulated by the following provisions of the International Convention on Travel Contracts (CCV) -Brussels, April 23, 1970 – art. n.1, n.3 and n.6; art. n.17 to n. 23; art. n. 24 to n. 31, with regard to provisions that differ from those regulating travel organization agreements and other agreements concerning the sale of the single service which is the object of the agreement. The Italian law punishes with imprisonment all crimes pertaining to pornography, and prostitution of minors, including when such crimes are perpetrated abroad.
21. JURISDICTION
bellaitaliadirect.com by Cinque Terre Riviera acts as a tour operator and independent agent in booking all accommodations listed. Except as otherwise set forth in the Guarantee, bellaitaliadirect.com and its employees, agents, representatives, affiliates, and owners (“Representatives”) shall not be liable for any and all losses, including actual, consequential, incidental, or punitive damages, incurred before, during or after customer’s stay in any accommodations rented through bellaitaliadirect.com and beyond its reasonable control. By placing a reservation with bellaitaliadirect.com, customers agree to and accept this Rental Agreement which constitute a contract with bellaitaliadirect.com and govern the reservation of all accommodations. The client agrees to hold harmless and indemnify bellaitaliadirect.com ,its Representatives and Owners from any such direct or indirect losses, including but not limited to consequential or incidental damages, expenses, claims, attorney’s fees, or personal injury. bellaitaliadirect.com reserves the right to refuse or discontinue service to any person or agent, and/or rescind any contract for accommodations in its sole discretion.These General Conditions are governed and construed in accordance with Italian law and the Italian Civil Code. We reserve the right to make changes to our website and to these General Conditions, at any time. In the event of any disputes arising out of this agreement the parties agree to submit to the exclusive jurisdiction of the Courts of La Spezia, Italy.
